Terms of Service

These terms are an agreement between you, the merchant using Callfox, and Callfox ("we", "us"), a sole proprietorship based in New Delhi, India. By installing Callfox or creating an account, you agree to them. Questions: hello@callfox.in.

1. The service

Callfox places automated voice calls, made by an AI agent, to your customers to confirm or cancel cash-on-delivery orders, and writes the outcome back to your store. The agent can make mistakes. Outcomes it isn't sure of are marked for your review, and you remain responsible for what you do with each order.

2. Your responsibilities

• You have the right to contact your customers about their orders, and you tell them, in your own privacy policy, that you may call them to confirm an order.
• You use Callfox only for calls about your customers' own orders and deliveries, not for marketing calls to people who haven't agreed to them.
• You follow the laws that apply to you, including India's telecom and Do-Not-Disturb rules and data protection law.
• You keep your account secure and are responsible for what happens under it.

3. Pricing and payment

• Callfox is free to install. Calls use prepaid minutes, bought in packs inside the app and billed through Shopify (or through our own invoicing for merchants not on Shopify). Current prices are shown in the app and on our pricing page.
• Answered calls are charged per started minute. Unanswered and failed calls are free.
• Purchased minutes don't expire.
• If your brand has its own phone number, its rental is taken from your minutes every 30 days. The amount is shown in the app before it applies.
• New stores may receive free starter minutes. They have no cash value.
• We may change prices with at least 30 days' notice. Minutes you've already bought keep their value.

4. Refunds

Minute packs are one-time purchases and are non-refundable, as Shopify shows when you approve the charge, except where the law requires a refund. Purchased minutes never expire, so unused minutes stay in your wallet for later. Free starter minutes have no cash value. If you think you were charged in error, write to hello@callfox.in.

5. How we process your customers' data

For your customers' personal data, you are the controller (the "Data Fiduciary" under India's Digital Personal Data Protection Act), and we process it on your behalf. We:

• process it only to provide Callfox to you, as described in our privacy policy, and never sell it or use it for anyone else;
• keep it confidential, encrypted in transit and at rest, and limit access to the Callfox team;
• use only the service providers listed in our privacy policy, and update that list before adding a new one;
• help you respond to your customers' requests to access or delete their data, including through Shopify's data requests;
• tell you without undue delay, and within 72 hours, if we become aware of a security incident affecting your customers' data;
• anonymise call data 365 days after each call, and erase your store's personal data when you uninstall Callfox and Shopify sends its deletion request.

6. Availability and changes

We work to keep Callfox running reliably, but we can't promise it will always be available or error-free. Phone networks and the AI providers we rely on can fail. We may improve or change features over time, and we'll tell you before any change that materially reduces what you've paid for.

7. Liability

To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profit or orders, and our total liability to you is limited to the amount you paid us in the 3 months before the claim.

8. Ending the service

You can stop at any time by uninstalling Callfox or closing your account. We may suspend or end your access if you break these terms, for example by using Callfox for unwanted marketing calls. If we end the service for reasons other than your breach, we refund your unused minutes.

9. Governing law

These terms are governed by the laws of India. Any dispute will be handled by the courts in New Delhi.

10. Changes to these terms

We may update these terms. We'll show the date at the top, and tell you in the app or by email before a material change takes effect. Continuing to use Callfox after that means you accept the new terms.
